These terms and conditions apply if you choose to take up a subscription or other type of license on CNCSimulator.com products. Please read them carefully as they affect your rights and liabilities under the law and set out the terms under which Techromic Solutions SA - CNCSimulator.com ("we" or "us") makes subscriptions available to you.
Subscription
A subscription entitles you to run a full version of the software for stated amount of time without having to come back to CNCSimulator.com to reactivate (“refill petrol”). Your subscription is personal to you and non-transferable. We reserve the right to refuse to accept any application for a subscription for any reason.
We reserve the right to withdraw or change any subscription offer, package and/or price at any time. This will not affect any subscription that you have already paid for, unless for some reason we are withdrawing a subscription offer due to our inability to fulfill that offer.
You agree to pay the subscription fees at the rates in effect when charges are incurred.
You are not required to pay VAT or delivery costs in relation to your subscription or license order. You must provide us with complete and accurate payment information. You can pay for your subscription by direct debit, credit or debit card.
You have the right to cancel your yearly subscription within 30 days after the order was made and get a full refund of your money. Cancellations must be done in writing to the email address stated above. The money will be reimbursed within a maximum period of 30 days from the cancellation date.The software needs working Internet access in order to start and run. We cannot guarantee that it will start every time as it is out of our control how the Internet behaves from day to day. The software is delivered “as is” and we do not return fees because of faulty behavior, bugs or other problems that can occur. If you feel unsure about paying for a subscription we offer you to try the software for free as long as you want by using our free “petrol” system (version 3.2 and earlier).A product license (subscription or other) allows for the use of the software on one computer only, unless it is not specifically sold a a multi-seat license (normally training institutes multi-seat license packs). The license can be moved to other computers up to four times a year by contacting support. Multi-seat license packs subscriptions for educational use are to be used on a limited set of computers. They are not floating in the sense that they can be installed on an unlimited number of computers and just the running instances are counted. For example, if a customer buys a 25-seat license, he can start the program on up to 25 computers. Trying to start on computer number 26 will fail. If the customer wants to move some or all of the individual installations to other computers he can contact support to have the installations table reset at our server. This is a quick process and we do not charge anything for it. As soon as the table has been reset, the customer can start on any 25 computers like when the license was new. We allow up to four resets per year.We do not include customizations like machine (or controller) specific interpreters, postprocessors or plug-ins in our prices.
Techromic Solutions SA accepts no responsibility for personal injuries, machine or other property damage, income loss or other problems caused by using the software.Included in the subscription fee is only the continuous use of the software and updates (only for subscriptions that includes updates). We do not include training, personal support or other special services besides what you already have as a free user. Support is offered via our online Help Desk only. If you feel that you need help over telephone or via direct chat, and that email or web contact is not for you, you will have to look elsewhere for software. Also do not buy the software if the use of it is so critical to your organization that you can not wait a few hours for a reply from support. Our customer support is open Monday to Friday from 8 am to 6 pm Eastern Standard Time (EST).
If you pay for a subscription by reoccurring debit there is no need to renew your subscription as it will continue until you cancel your reoccurring debit and we will take payment every month/quarter/six months/year according to the subscription package you choose. If we change the subscription price we will inform you of this so that you can choose whether or not to cancel your subscription.
If you have paid by credit or debit card without reoccurring debit, we will remind you that your subscription is due to expire before it does. If we have changed the subscription price since your last payment we will inform you of this in the renewal reminder notice so that you can choose whether or not to proceed with the renewal.
We may cancel your subscription immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions, including if we do not receive a payment when due from you.If we decide to cancel your subscription immediately, for any reason, you are entitled to a partial refund corresponding to the number of days you have left on the license. As an example, if on a yearly subscription, you have 182 days left, you would be refunded half of what you paid for the subscription. If we on the other hand cancel it by letting the license stay active until its due date, no refund, partial or full, is offered. If the refund is to be made via a bank transfer, the customer pays for any transfer, and/or other charges that may occur.
If you pay for your subscription by reoccurring debit you can cancel the reoccurring debit by logging in to your account or by emailing us at . Yearly subscriptions need to be canceled at least 30 days before the next payment is due. Monthly subscriptions can be canceled at any time before the recurrent debit is due. We do not refund the last payment in case the cancellation is late.We do not send reminders to subscription customers before a recurring charge is executed. All subscription customers must keep track of when the fee will be charged and contact us or 2checkout.com if they want to cancel the subscription. If you want a subscription for just one year, contact us after your order so we can cancel the automatic recurrent charge of your credit card.
Besides subscriptions, we also offer non-subscription Licenses. The same conditions apply to these licenses as to them of subscriptions with the exception that they do not include updates. These licenses are only charged once. Updates are sold separately. Special terms for CNC Simulator Classic. Upon buying a license of the now obsolete CNC Simulator Classic the buyer agree to the following terms:
1. The software is no longer developed or supported.
2. The software is sold “as is”.
3. Once the key is delivered, no refund can be done.
4. The license is for the computer where the simulator is installed only. If the computer breaks, the operating system is re-installed or the program stops working for any other reason, the license is lost and will not be replaced.
